Article 1 (Definitions)
The terms used in these Terms are defined as follows: (1) This Service The service and related services operated by the App Provider (2) This Site The website where the content of this Service is published (3) This Content A general term for text, sound, still images, videos, software programs, code, etc. provided on this Service (including posted information) (4) Users All persons who use this Service (5) Registered Users Persons who have completed user registration on this Site (6) Personal Information A general term for information that can identify individuals, such as address, name, occupation, telephone number, etc. (7) Registration Information A general term for information registered by Registered Users on this Site (8) Intellectual Property Inventions, devices, new plant varieties, designs, copyrighted works and other products of human creative activity (including natural laws or phenomena that have been discovered or elucidated and have industrial applicability), trademarks, trade names and other items used in business activities to indicate products or services, and trade secrets and other technical or business information useful for business activities (9) Intellectual Property Rights Rights established by laws and regulations or rights relating to legally protected interests regarding intellectual property, such as patent rights, utility model rights, breeder's rights, design rights, copyrights, trademark rights, and other intellectual property
Article 2 (Agreement to these Terms)
1. Users may use this Service after agreeing to these Terms of Use. 2. When a User downloads this Service to a smartphone or other information device and completes the procedure for agreeing to these Terms, a use contract based on the provisions of these Terms shall be established between the User and the App Provider. 3. If a User is a minor, please use this Service after obtaining the consent of a person with parental authority or other legal representative. 4. If a minor User uses this Service by falsely claiming to have the consent of a legal representative when such consent does not exist, or by falsely claiming to be of legal age, or by using fraudulent means to make others believe that the User has legal capacity, the User may not cancel any legal acts related to this Service. 5. If a User who was a minor at the time of agreeing to these Terms uses this Service after reaching the age of majority, such User shall be deemed to have ratified all legal acts related to this Service.
Article 3 (Changes to these Terms)
1. The App Provider may revise the content of these Terms at any time without obtaining the consent of Users, and Users shall accept this without objection. 2. When the App Provider revises these Terms, the App Provider shall notify Users of the content by the method prescribed by the App Provider. 3. The revision of these Terms shall become effective from the time the App Provider gives notice pursuant to the preceding paragraph. 4. When a User uses this Service after these Terms have been changed, the User shall be deemed to have agreed to the revised Terms of Use without objection.
Article 4 (Handling of Personal Information, etc.)
Personal information and User Information shall be handled appropriately in accordance with the "PracticeLog Service Privacy Policy" separately established by the App Provider.
Article 5 (Prohibited Acts)
When using this Service, the App Provider prohibits Users from engaging in the following acts. If the App Provider determines that a User has violated the prohibited matters, the App Provider may take measures deemed necessary by the App Provider, such as suspending use or deleting posts, and Users shall agree to this without objection. (1) Acts that infringe on the intellectual property rights of the App Provider or third parties (2) Acts that damage or unjustly discriminate against or slander the honor or reputation of the App Provider or third parties (3) Acts that infringe on the property of the App Provider or third parties, or acts that may infringe on such property (4) Acts that cause economic damage to the App Provider or third parties (5) Threatening acts against the App Provider or third parties (6) Acts that place excessive stress on the infrastructure equipment for this Service (7) Attacks on the servers, systems, or security of this Site (8) Acts that attempt to access the App Provider's Service by means other than the interface provided by the App Provider (9) Other acts deemed inappropriate by the App Provider
Article 6 (Handling of Content)
1. Users may use the content of this Service only within the scope defined by the App Provider. 2. The App Provider owns the rights to all content provided in this Service, and does not grant Users the right to practice or use the patent rights, utility model rights, design rights, trademark rights, copyrights, or other intellectual property rights held by the App Provider. 3. Users are prohibited from reproducing, transmitting, transferring (including sales between Users), lending, translating, adapting, reprinting without permission, secondary use, commercial use, modification, disassembling, decompiling, reverse engineering, etc., in any manner beyond the scope of use defined by the App Provider. 4. Notwithstanding the preceding paragraph, if a User loses User status due to withdrawal, etc., the right to use the provided content shall also expire. 5. Users shall own the rights to content (recording files, practice records, sheet music masking settings, and all other information) created and stored through this Service. Such content is stored only on the User's device and is not acquired or used by the App Provider. 6. Users shall not exercise moral rights of authorship within this Service.
Article 7 (Disclaimer)
1. The App Provider shall not be liable for any damages resulting from changes to, interruption of, or termination of this Service. 2. The App Provider shall not be involved in or liable for the environment in which Users use this Service. 3. The App Provider does not guarantee that this Service will meet the User's specific purposes, have the expected functions, commercial value, accuracy, or usefulness, that the User's use of this Service will comply with laws and regulations or internal rules of industry groups applicable to the User, or that no defects will occur. 4. The App Provider does not guarantee that this Service is compatible with all information devices, and Users acknowledge in advance that defects may occur in the operation of this Service due to version upgrades of the OS of the information devices used for this Service. The App Provider does not guarantee that such defects will be resolved by program corrections performed by the App Provider when such defects occur. 5. Users acknowledge in advance that the use of all or part of this Service may be restricted due to changes in the terms of use and operational policies of service stores such as the AppStore and GooglePlay. 6. The App Provider shall not be liable for any damages directly or indirectly incurred by Users as a result of using this Service. 7. The App Provider shall not be liable for any damage (including indirect damage or lost profits) such as lost opportunities or business interruption that occurs to Users or other third parties, even if the App Provider has been notified in advance of the possibility of such damage. 8. When there is a request from another User or a third party to delete a post, the App Provider may decide whether to delete it at the App Provider's discretion, and the App Provider shall not be responsible for any consequences arising from such decision. 9. The provisions of paragraphs 1 through the preceding paragraph shall not apply if the App Provider has willful misconduct or gross negligence, or if the contract falls under a consumer under the Consumer Contract Act. 10. Even if the preceding paragraph applies, the App Provider shall not be liable for damages arising from special circumstances among damages incurred by Users due to acts of negligence (excluding gross negligence). 11. If the App Provider is liable for damages in connection with the use of this Service, the App Provider shall be liable for damages up to the amount of usage fees received from Users in the month in which the damage occurred. 12. The App Provider shall not be responsible for disputes and troubles between Users and other Users. Even if troubles arise between Users and other Users, they shall be resolved at the responsibility of both parties, and no claims shall be made against the App Provider. 13. If a User causes damage to another User or a dispute with a third party in connection with the use of this Service, the User shall compensate for such damage or resolve such dispute at the User's own cost and responsibility, and shall not cause any inconvenience or damage to the App Provider. 14. If the App Provider receives a claim for damages from a third party due to a User's actions, the User shall resolve it at the User's cost (attorney's fees) and responsibility. If the App Provider pays damages to the third party, the User shall pay the App Provider all costs (including attorney's fees and lost profits) including such damages. 15. If a User causes damage to the App Provider in connection with the use of this Service, the User shall compensate the App Provider for damages (including litigation costs and attorney's fees) at the User's cost and responsibility. 16. The App Provider does not guarantee the accuracy of information posted by other Users in this Service. The App Provider shall not be responsible for any disputes or troubles regarding information posted in this Service.
Article 8 (Posting of Advertisements)
Users understand and are deemed to have consented that this Service may include various advertisements, and that the App Provider or its partners may place various advertisements. The form and scope of advertisements on this Service may be changed by the App Provider at any time.
Article 9 (Prohibition of Transfer of Rights)
1. Users shall not transfer all or part of their status under these Terms or rights or obligations under these Terms to a third party without the prior written consent of the App Provider. 2. The App Provider may transfer all or part of this Service to a third party at the App Provider's discretion, and in such case, all rights of Users related to this Service, including User accounts, shall be transferred to the transferee within the scope of the transferred rights.
Article 10 (Severability)
Even if any provision of these Terms or part thereof is deemed invalid or unenforceable under the Consumer Contract Act or other laws and regulations, the remaining provisions of these Terms and the remaining portions of provisions deemed partially invalid or unenforceable shall continue to be fully effective.
Article 11 (Method of Contact with the App Provider)
Users shall contact or inquire with the App Provider regarding this Service by submitting through the inquiry form installed at an appropriate location within this Service or the website operated by the App Provider, or by a method separately designated by the App Provider.
Article 12 (Governing Law and Jurisdiction)
1. The validity, interpretation, and performance of these Terms shall be governed by and construed in accordance with Japanese law. 2. Any disputes, litigation, or other conflicts between the App Provider and Users shall be subject to the exclusive agreed jurisdiction of the Tokyo Summary Court or the Tokyo District Court, depending on the amount in dispute.
